There are two most common complaints. One: the desire to go back to being on a Hiring Committee instead of an Advisory Committee, when faculty were allowed to make recommendations instead of just advise. Two: administrative overrides in everything from the position announcement to the actual faculty hire.&lt;br /&gt;&lt;br /&gt;For the past three years, the Meet and Confer team has been working with the College on the Faculty Hiring Process to strengthen the role of faculty. Once again, the College has given us permission to assist in modifying the Hiring SPG to make the process run more smoothly. Our comments today concern the proposed BOG Standard Practice Guide SPG-3202/AA: Course Materials. PCCEA appreciates the College's diligence in ensuring that College Policies adhere to state law and we recognize the value of implementing standard practices for all College employees. However, we have some areas of concern with regard to how this SPG delineates the interpretation and implementation of ARS 13-1891. &lt;/p&gt;&lt;p&gt;Concerns&lt;br /&gt;· &lt;strong&gt;Section B.&lt;/strong&gt; Faculty members are directed to request in writing information about the class materials from the publishers. The burden of requesting this information most often will fall on the shoulders of the Department Chairs and Lead Faculty, who typically already are overburdened with the tasks of scheduling, staffing and securing course materials. Obviously, the latter interpretation places a much more reasonable burden on the faculty. &lt;span style="color:#990000;"&gt;PCCEA requests that Item B specifically state that the information requested be limited to semesters in which a new material is selected&lt;/span&gt;.&lt;br /&gt;· &lt;strong&gt;Section C.&lt;/strong&gt; Regarding ownership of free review copies, the Guide states, "Such materials provided by the publisher at no charge are presumed to be the property of the faculty member or employee." Are we to assume, then, that as owners of such materials, faculty may dispose of those materials however they see fit? &lt;span style="color:#990000;"&gt;PCCEA requests an addendum that states faculty are permitted to dispose of their property as they deem appropriate&lt;/span&gt;. &lt;/p&gt;&lt;p&gt;Of less importance are various grammatical errors that also need to be addressed. We are happy to assist with those corrections if a Word file is provided to facilitate the modification process. &lt;/p&gt;&lt;/blockquote&gt;&lt;br /&gt;&lt;p&gt;&lt;br /&gt;The Standard Practice Guide (SPG) is based on the Arizona statute (ARS 15-1891) that was passed last year and reflects that language almost verbatim. PCCEA appreciates the&lt;br /&gt;revisions made to the initial BOG Standard Practice Guide SPG-1505/BB: &lt;br /&gt;Mandatory Reporting-Abuse of a Minor. &lt;br /&gt;There remain two monumental concerns regarding the College's proposed Standard Practice Guide ensuring College employees comply with ARS 12-3620:  1) Student age and 2) Communication of Policy.&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span&gt;&lt;/span&gt;&lt;span&gt;STUDENT AGE  In reviewing the second draft of this policy, the language in paragraph 2 of section 2.1 implies that a College employee should apply a different standard of sensitivity to victims based on the victim's current age.  As stated in our review of the initial SPG, College employees typically do not know the age our students; therefore, &lt;span style="color:#ff0000;"&gt;&lt;strong&gt;PCCEA believes it is inappropriate to write policy giving direction based on information not readily available to all College employees.&lt;/strong&gt;&lt;/span&gt;  Given the restrictions on which questions can be asked (which do not include clarification of age) it seems prudent only for law enforcement personnel to employ different standards for investigation.&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span&gt;&lt;/span&gt;&lt;span&gt; &lt;/p&gt;&lt;blockquote&gt;&lt;span&gt;Section 2- Reporting Responsibilities&lt;br /&gt;2.1&lt;br /&gt;(second paragraph) … "In&lt;br /&gt;forming a reasonable belief, a College employee should&lt;br /&gt;use discretion in&lt;br /&gt;asking questions of a victim (or third party) &lt;span style="color:#999999;"&gt;who is 18&lt;br /&gt;years&lt;br /&gt;of age or  older.  In asking questions of a victim (or third&lt;br /&gt;party)&lt;br /&gt;who is less than 18 years of age,&lt;/span&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;When&lt;br /&gt;discussing the abuse with a victim (or&lt;br /&gt;third party)&lt;/span&gt;&lt;strong&gt; &lt;/strong&gt;&lt;/em&gt;particular care needs to be taken not to re-traumatize the victim&lt;br /&gt;and/or compromise any criminal investigation.  If the College employee&lt;br /&gt;believes the victim (or third party) &lt;span style="color:#c0c0c0;"&gt;is&lt;/span&gt; &lt;em&gt;&lt;span style="color:#3333ff;"&gt;may be&lt;/span&gt;&lt;/em&gt; less than 18 years of age,&lt;br /&gt;&lt;span style="color:#c0c0c0;"&gt;College employees should either&lt;/span&gt; &lt;em&gt;&lt;span style="color:#3333ff;"&gt;it&lt;br /&gt;is preferred that the College employee&lt;/span&gt;&lt;/em&gt; not ask any questions of the &lt;span style="color:#c0c0c0;"&gt;person&lt;/span&gt; &lt;span style="color:#3333ff;"&gt;&lt;em&gt;victim&lt;/em&gt;&lt;/span&gt;.  &lt;em&gt;&lt;span style="color:#3333ff;"&gt;Any&lt;br /&gt;questions asked of the victim should be limited to only&lt;/span&gt;&lt;/em&gt;&lt;span style="color:#c0c0c0;"&gt;, or should limit questions to&lt;/span&gt; the&lt;br /&gt;following:  what happened?; who did it?; and where were you when it&lt;br /&gt;happened?” &lt;/span&gt;&lt;/blockquote&gt;&lt;p&gt; &lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span&gt;&lt;/span&gt;&lt;span&gt;COMMUNICATION OF POLICY&lt;br /&gt;PCCEA would again like to express our obligation to ensure that students be informed in advance about the legal requirement that College employees bear in reporting to law enforcement any past or present abuse of a minor.   PCCEA appreciates the College's commitment to developing language for informed consent; however, to strengthen the importance of this statement, &lt;strong&gt;&lt;span style="color:#ff0000;"&gt;PCCEA requests that an additional section be added to this SPG to mirror language already in place under SPG-1501/AD&lt;/span&gt;&lt;/strong&gt;:  ADA &amp;amp; Equal Opportunity, Reasonable Accommodation Guideline for Students.   Please see suggestions below. &lt;/span&gt;&lt;/p&gt;&lt;span&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;&lt;blockquote&gt;&lt;span&gt;&lt;em&gt;&lt;span style="color:#3333ff;"&gt;&lt;strong&gt;Section 4 - Other Considerations&lt;br /&gt;4.1     Faculty Responsibilities:&lt;br /&gt;&lt;/strong&gt;4.1.1  Each syllabus will include a statement notifying individuals about the “Mandatory Reporting of Abuse of a Minor” state statute and PCC SPG.&lt;br /&gt;For example: "Pima Community College complies&lt;br /&gt;with Arizona State Statues pertaining to immediate reporting of abuse of a minor.  Abuse is defined as sexual, physical or neglect, and a minor is defined as a person under age 18 (ARS 13-3620). Students who disclose abuse of a minor, either personally experienced as a minor anytime in the past or present, or that of another minor, to any College employee legally requires that employee to file an immediate report to PCC DPS”. (PCC SPG-1505-/BB).&lt;br /&gt;&lt;strong&gt;4.2.      Training&lt;/strong&gt;&lt;br /&gt;4.2.1   All College employees will participate in training as coordinated by PCC DPS.  New employees will complete training as part of their new employee orientation.&lt;br /&gt;4.2.2   A mandatory training session for all campus personnel will be scheduled annually as needed for updates. &lt;br /&gt;4.2.3   Faculty, staff, and administrators will be expected to participate in scheduled training sessions provided by PCC DPS and updates as required.&lt;br /&gt;&lt;strong&gt;4.3.     Communication&lt;/strong&gt;&lt;br /&gt;Information pertaining to SPG-1505-/BB and ARS 13-3620&lt;br /&gt;will be publicized and made known on all campuses and to all students. Brochures and other types of materials will be developed to explain student rights and to explain College policies and procedures for mandatory reporting. PCCEA apologizes for the oversight.&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;strong&gt;&lt;br /&gt;&lt;/strong&gt;&lt;/span&gt;&lt;span style="font-family:verdana;"&gt;&lt;strong&gt;PCCEA Memo&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;To: Chancellor Flores&lt;br /&gt;From: Ana Jiménez, PCCEA Vice President&lt;br /&gt;Date: October 1, 2008&lt;br /&gt;RE: Draft SPG 3201/AA&lt;br /&gt;&lt;br /&gt;PCCEA appreciates the opportunity to comment on the proposed BOG Standard Practice Guide &lt;/span&gt;&lt;a href="http://www.pima.edu/policies/standardguidlines/2007Draft/SPG-3201-AA-Draft.pdf" target="_blank" rel="nofollow"&gt;&lt;span style="font-family:verdana;"&gt;SPG-3201/AA&lt;/span&gt;&lt;/a&gt;&lt;span style="font-family:verdana;"&gt;: Occupational Program External Advisory Committees (OPEAC). We acknowledge the modifications that were made to the first draft of this SPG and note the College’s willingness to discuss this topic further. In reading through this new draft, we see that the new language still does not allow for a faculty co-chair, and it does not allow for faculty participation in the advisory committee meetings. If the advisory committee does not have the Lead Faculty as co-chair, we do not believe that the committees will be effective for many reasons including the following:&lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;span style="font-family:verdana;"&gt;&lt;br /&gt;1. The lead faculty is aware of the needs of the program and is really the only person who is capable of knowing what should be on the agendas of the meetings and what the timelines and deadlines should be for completion of committee business. &lt;/span&gt;&lt;/p&gt;&lt;span style="font-family:verdana;"&gt;&lt;p&gt;&lt;br /&gt;2. For many occupational programs, curriculum matters originate in the advisory committee, placing the committee in charge of drafting new curriculum and curriculum review and revision. These duties require the expertise of a faculty member. &lt;/p&gt;&lt;p&gt;&lt;br /&gt;PCCEA respectfully requests again, for the sake of the functionality of the committee, that the Lead Faculty be allowed to be the co-chair of the advisory committee. We request that the language in E be modified to reflect this. PCCEA also requests that faculty be able to participate in meeting business, versus simply observing. Faculty should be allowed to participate based on the needs of the committee. Please see proposed language changes in red below.&lt;/p&gt;&lt;p&gt;&lt;br /&gt;E. &lt;span style="color:#000099;"&gt;One co-&lt;/span&gt;chair is filled by an individual external to the College, who will be elected by the committee members for a one-year renewable term. &lt;span style="color:#cc0000;"&gt;The other co-chair position will be filled by the Lead Faculty for the program.&lt;/span&gt; &lt;span style="color:#c0c0c0;"&gt;The Division Dean for a single campus program or The College Discipline Area Committee (CDAC) Chair for a multi-campus program will serve as the other co-chair of the committee &lt;/span&gt;&lt;/p&gt;&lt;p&gt;&lt;br /&gt;C.
